The Murray Trachtenberg-Terry Belhumeur-Lionel Chartrand connection!


Good Day Readers:
So the letter from MMF lawyer Murray Trachtenberg (below) makes sense a little explanation is required. We're currently going through a process in the taxpayer financed Manitoba Metis Federation's defamation lawsuit against the now defunct www.CyberSmokeSignals.com called Witness Evidentiary Summaries. Both sides are required to provide brief written statements to the judge presiding over the Case Management Meetings justifying those they would like subpoeaned to testify at trial.
At a November 13, 2009 meeting Co-Defendant Terry Belhumeur told the court former Manitoba Legal Aid lawyer, one time CSS.com General Legal Counsel and current Wetaskiwin, Alberta Crown Prosecutor Lionel Chartand had told him he was prepared to return to Winnipeg at his own expense to testify at trial.
Court of Queen's Bench Justice K. I. Simonsen then specificially instructed Mr. Belhumeur to contact court officials here to find out what was involved in issuing an out-of-province subpoena and, should he require assistance, to contact Mr. Trachtenberg. He was also asked to secure a letter from Mr. Lionel Chartrand confirming he was indeed prepared to waive travel expenses as previously indicated.
From Counselor Trachtenberg's letter it would appear Co-Defendant Belhumeur has done nothing.

When we were last before Justice Simonsen, she indicated to you that you would have to obtain a subpoena if you wish to call Mr. Lionel Chartradn as a witness. As you know we have received an email from Mr. Chartrand outlining his available dates.
Have you started the process to obtain the subpoena and confirm Mr. Chartrand's availability for the date/dates you wish him to attend?
Mr. Pieuk also indicated that he intended to call Mr. Chartradn as as a witness so perhaps the tow of you should coordinate when Mr. Cahrtrand is to appear and who will be responsible for issuing the subpoena.
