Good Morning Mr. Pieuk,

While I appreciate your nomination, thankfully, as I am not a lawyer, I cannot sit on the inquiry. Quite honestly, I do not believe that I could be impartial anyway.

As for your question, I do not see any reason for you to NOT file a complaint with the FLSC, though I doubt it will have much impact. I think that if the CJC inquiry into Douglas goes ahead, the LSM will be subjected to far more intense scrutiny for its conduct and complicancy within the context of the public inquiry when it is called to give evidence regarding her endorsement for the bench. Needless to say, the legal community in Manitoba sits with bated breath.

As an aside, I'm not actively working at the cottage site anymore (we are under an evacuation order), but am dealing with the red tape regarding compensation and/or rebuilding. But the wife and I thank you for your thoughts. We are both very thankful that it is not our residence, but the flood has put a wrinkle into our retirement plans.

Exactly our point! Judges and lawyers do not enjoy an exclusive monopoly on brains or impartiality. You'd be an outstanding candidate to sit on the Canadian Judicial Council's upcoming public inquiry. Face it, you couldn't do any worse than those already there.

Yes, I will file a formal complaint against the Law Society of Manitoba with the Federation of Law Societies of Canada and post it on this site. Like you I agree it will probably have the impact of peeing in the ocean. Regardless, there is a principle involved. The LSM should not be allowed to misinterpret the rules relating to attendance at Pre-Hearing Conferences otherwise it becomes a very easy mechanism for excluding mainstream media, as well as, citizen journalists/bloggers from portions of its meetings dealing with what should be publicly accessible information such as discussions of motions brought before it and Charter challenges - Blackie's file is a good case in point.

Regarding the issues with your cottage we can relate on a personal level. In the aftermath or the 1997 "Flood of the Century!" we were retained by The Federal Business Development Bank to help administer an aid program for those impacted. Suffice it to say we had an opportunity to travel the province to view the devastation up close and personal. It was really quite sad to watch those directly affected struggle to put their lives back together.
