At the Law Courts!


Spent a few hours earlier this week at the Law Courts Building doing research.
Judge Corrin
Looked at the file (6-pages of forms) for Judge Brian Corrin. You'll recall he's the provincial court judge (appointed 1988) who in late February of this year was formally charged by the Winnipeg Police Service. The Warrant for Arrest lists assault and uttering a threat to cause death or bodily harm, specifically:
(1) Brian Mark Corrin on or about the 19 day of February in the year 2011 at the City of Winnipeg in the Province of Manitoba did commit an assault on Celia Corrin contrary to section 266 of the Criminal Code of Canada
(2) that Brian Mark Corrin on or about the 19 day of February in the year 2011 at the City of Winnipeg in the province of Manitoba did knowingly utter a threat to Celia Corrrin to cause death or serious bodily harm to Celia Corrin contrary to Section 261.1(1)(a) of the Criminal Code of Canada
The relationship of Mr. Corrin to Celia Corrin was not identified.
Mr. Corrin gave an undertaking to a police officer that he would abstain from communicating directly or indirectly with Celia Corrin or from going to within 200 meters of her residence (we have omitted the address provided on the document), or any place of worship.
From the paperwork filed to date it appears Winnipeg lawyer Richard Wolson (Ginden, Wolson, Simmonds Roitenberg) is representing Mr. Corrin. An initial hearing was held on June 20th of this year (no details available). The next will be August 15, 2011 in Courtroom 302 which we were told will be open to the public.
Noticed one of the police forms had been marked with a square, red CPIC stamp. We inquired of the court clerk as to its meaning. It would appear particulars regarding Judge Corrin's charges have been entered into the Canadian Police Information Centre data base.
Bail Hearings
When they dried up in one courtroom we simply walked down the hallway to another where there were others underway. These are usually pretty standard cut and dried proceedings so Manitoba Justice uses its junior Crowns much like the duty Crown if you call the Prosecutor's Office.
We posed a question to a couple but got the bum's rush. In the Casey Anthony case you'll recall her daughter was missing for 31-days before it was reported to authorities yet the mother was never charged. Hence the national petition for a "Caylee's Law" to cover such situations. Our question, "Had this happened in Canada" would a parent or legal guardian have been charged and if so with what?
Both young Crowns wobbled around without coming up with a clear answer which may explain why we got the bum's rush in the first place - they didn't know! Why some freshly minted lawyers leave law school with a misplaced sense of entitlement is beyond us?
Queen's Bench File Number CI 11-01-69949
This case caught our attention because of "Dear Friend" Murray Norman Trachtenberg's involvement acting for the Plaintiff. He's the Winnipeg lawyer who prosecuted the taxpayer financed defamation lawsuit (a classic textbook SLAPP - Strategic Lawsuit Against Public Participation) filed by the Manitoba Metis Federation against our precursor site (MMF et al. versus Terry Belhumeur et al. - http://www.jus.gov.mb.ca/, File Number CI 05-01-41955).

This was a small potatoes case, unless of course, you were the Defendant (Paris Jewellers Limited) and Ly Hua carrying on business as Paris Jewellers. A Notice of Discontinuance was filed resulting in Mr. Hua being ordered to pay the Plaintiff (Gee N'Gee Importers) $16,114.62 plus $1,508.50 for the costs of the action plus interest at the rate of 1.5% per year.
