Recently we received an "offer to settle" from MMF lawyer Murray Trachtenberg - Posner & Trachtenberg (www.ptlaw.mb.ca; mtrachtenberg@ptlaw.mb.ca) in the taxpayer funded Manitoba Metis Federation's alleged defamation lawsuit (CI 05-01-41955) against the now defunct www.CyberSmokeSignals.com.
Because his letter was marked "Without Prejudice" we cannot publish it vertabim on the internet otherwise we would.
As for Lionel Chartrand, he has gone on to become a Crown Prosecutor in Wetaskiwin, Alberta (lionel.chartrand.gov.ab.ca)

Dear Mr. Trachtenberg:
Please be advised your clients’ offer to settle dated September 29, 2009 is hereby and forthwith categorically rejected.
Recall, Sir, on May 16, 2006 I offered the Plaintiffs:
(1) $18 based on a Toonie for David Chartrand in deference to his position as President of the Manitoba Metis Federation plus a Loonie for each remaining Provincial Board of Director
(2) Posting for ten (10) calendar days on www.CyberSmokeBlog.blogspot.com of a retraction/apology letter authored by Mr. Lionel Chartrand which initially appeared February 11, 2004 on opinions@metisvoices.com. The allegedly defamatory material in question was:
(i) Written by Lionel R. Chartrand www.CyberSmokeSignals.com’s General Legal Counsel at the time it was published on the internet
(ii) Approved for publication by Mr. Lionel Chartrand
(3) At no material time did Lionel Chartrand advise the site’s registered owner, Co-Defendant Terry Belhumeur, or me his (Lionel Chartrand’s) comments might be defamatory. Nor did he subsequently advise or request they be removed
(4) The Manitoba Metis Federation display Mr. Lionel Chartrand’s apology/retraction letter on its website (www.mmf.mb.ca) for ten (10) calendar days
(5) The Plaintiffs agree to pay all Co-Defendant Pieuk’s legal costs plus interest forthwith
(6) A Notice of Discontinuance be issued for Co-Defendant Pieuk
At no time, Sir, have you had the courtesy or professionalism to acknowledge this generous offer. However, I still remain open to:
(1) Payment now of $16 to the Plaintiffs in recognition two have subsequently signed Notices of Discontinuance
(2) A written letter of apology/retraction from each of the Plaintiffs for initiating a taxpayer financed lawsuit which is, “irrelevant and/or scandalous and/or vexatious”
(3) Payment of any and all of my legal fees and expenses with interest
Please govern yourself accordingly.

Congratulation! Your hard work IS MOSTLY paid off.
YOU ARE RIGHT, TELL THEM TO: "GOVERN YOUR SELVES ACCORDINGLY".
I could not believe how these plaintiffs went through so much trouble, and used so much tax payers' money trying to prove that, they were right, while knowing in their hearts and minds that, they were all wrong in this massive litigation against you.
Further more, that cheap settlement offer is not worth how much it costs in this huge litigation, in my opinion.
However, since we have to turn everything to positive, this case may be regard as, an expensive study research. Therefore, this case's documents must be reserved for the Canadian Law Society. It's an excellent brain stimulating for those Law school students i.e. from: "Law is cool" establishment. I recommend them follow this case.
I command you to go all the way through transparency, to bring justice to lights, and show the Canadians that:
THIS IS THE WAY; THE VICTOMS OF RULES OF LAW HAVE TO DO IN ORDER TO PROTACT THEMSELVES.
UNFORTUNATELY, NOT EVERYBODY IN THIS SOCIETY IS "MR.CLARE L.PIEUK".
THAT MEANS, THOSE VICTOMS OF THE LAW ARE EXPACTED TO SUFFER INJUSTICE FOR THE REST OF THEIR LIVES, WHILE THEIR EVILS PREDITORS CAN GET AWAY WITH MUDERS TIME AFTER TIMES. SHAME ON US CANADIANS!
