Dear Messrs Trachtenberg, Pieuk and Belhumeur,

It has come to my attention that a trial in the above matter may be held during the month of March, 2010, and that one or more parties may wish to subpoena me as a witness.

Please be advised that my work schedule is already made up for the month of March, 2010 and I will provide with my list of available dates that are at least 2 consecutive days.

I am available March 9 & 10; 18 & 19; 23, 24, 25 and 26; and March 30, 31 and April 1st.

If I could be called as a witness on any of those series of dates, it would prevent the necessity for me to attempt to try to re-schedule court appearances that I am scheduled for in Alberta.

Further, given that the subject matter of the litigation will be about 6 years old, I believe it would be helpful for any party planning to call me as a witness to provide me with a list of points regarding the factual matters or issues that you feel I could give material evidence on, so that I could take the opportunity prior to any court appearances to review printed materials to refresh my memory on the specific matters in contention.
