Recently while reseaching the Court of Queen's Bench online file registry we noticed a name familiar to many of our readers - Murray N. Trachtenberg Manitoba Metis Federation President David Chartrand's defamation lawyer. The case appears to have been significant with over 130 documents listed beginning in June 1989 and ending September of 1995. In May 1994 the Plaintiff was awarded slightly more than $341,000:
Recently while reseaching the Court of Queen's Bench online file registry we noticed a name familiar to many of our readers - Murray N. The case appears to have been significant with over 130 documents listed beginning in June 1989 and ending September of 1995. In May 1994 the Plaintiff was awarded slightly more than $341,000:
Canada Trustco Mortgage Company (Plaintiff) vs Kansa General Insurance Company Limited (Defendant), Jevco Insurance Management Incorporated (Defendant), Aikins Maculay & Thorvaldson (Third-Party Defendant) and Murray N. Trachtenberg (Third Party Defendant) - CI89-01-38473)
The records suggest a Notice of Discontinuance was issued for Mr. Trachtenberg (January 10, 1992) who is shown to have subsequently sworn an Affidavit (January 11, 1994). The Statement of Claim was originally registered June 8, 1989 while the Statement of Defence August 15, 1989. According to court recourds Counselor Trachtenberg was Third-Partied June 4, 1991. It's interesting to note how quickly he was released from the lawsuit (a little over 6 months after the Third-Party Claim was filed against him and 3 months subsequent to registering his Statement of Defence).
The Statements of Claim (S/C) and Defence should prove interesting given the Third-Party Claim against Mr. Trachtenberg was issued significantly after both these documents were filed.
Finally, the timeline of events is worth noting. According to Mr. Trachtenberg's resume posted on his website (www.ptlaw.mb.ca) he was associated with Aikins Maculay & Thorvaldson from 1980-1990. The S/C was filed in 1989 subsequent to which he left in 1990 to join Walsh Micay & Company where in October 1994 he was one of three Defendants named in a lawsuit involving a disputed Will.
Sincerely,
Clare L. Pieuk
