Leave him alone you dummies that's Blackie from Winnipeg!




Good Day Readers:
Sorry for the delay in getting back to you regarding yesterday's Law Society of Manitoba Disciplinary Committee Hearing for Blackie who cannot be identified - Yet! - under provisions of The Legal Profession Act. As far as we're able to ascertain The LPA is silent on the issue of whether the complainant(s) can be publicly named so are continuing to research the matter. BTW, Blackie was absent and may be on the run or hiding out possibly somewhere in the Los Angeles area.
After receiving an independent, third-party legal opinion it has been determined the comments below constitute legal, public interest analysis by a citizen journalist/blogger because:
(1) yesterday's meeting was a public Hearing
(2) The Society has issued no publication ban of any kind against this site
Blackie will be prosecuted on behalf of the LSM by Bencher David M. "Dapper" Skwark

The Hearing was over almost before it began - under 30 seconds or less. Blackie has filled at least one Motion to have The Dapper Counselor recuse himself (step aside) on the basis of a possible conflict of interest - presumably there could be other covering a wide range of other prosecutorial issues. It seems he and Blackie were representing opposite sides in a lawsuit a few years ago. Why The Society was unaware or knowingly chose to ignore this fact is beyond our ability to comprehend.

Mr. Skwark moved to:

(i) compel Blackie to serve him with the Affidavit accompanying the Motion for recusal plus any other evidence he intends to rely on by 9:30 a.m. the morning of Tuesday January 4, 2011 at which time the matter will be adjourned. A Set Down List will be set for 12:30 p.m. that same day

(ii) Prosecutor Skwark will advise the Disciplinary Committee how much time will be required to respond to Blackie's submissions. A date and time will then be set to hear the recusal Motion - CyberSmokeBlog will be present

(iii) Disciplinary Committee Chairman Ted Bock (Aikins MacAuley & Thorvaldson) was to have presided over the January 4, 2011 (12:30) Set Down List.

However, Blackie objected so it will be conducted by Peter Cole, Q.C.

(iv) Yesterday's meeting was chaired by Mr. Cole with Mr. Bock connected by conference call

If any of the 5-individuals who attended yesterday's meeting, or Blackie for that matter wherever you are, disagree with our comments please contact us and we'll consider making changes. All requests will be published.

Finally, we'd like to thank a senior Law Society official who we've code named "Blanche" for the respectful, classy way in which they've dealt with us even though we've had, and still do, ongoing disagreements over the interpretation and meaning of certain provisions of The Legal Profession Act.
