Update in the Canadian Judicial Council's review of certain allegations regarding the Honourable Lori Douglas

Ottawa, October 16, 2013 - Council recently announced that certain questions regarding Associate Chief Justice Douglas, including her use of a "representational allowance," had been referred to the Vice-Chair of the Judicial Conduct Committee for review. This follows a letter of concern from Chief Justice Joyal in this regard.

Associate Chief Justice Douglas has been the subject of an ongoing Inquiry held pursuant to the Judges Act. Certain matters relating to the Inquiry are now pending before the Federal Court. Independent Counsel in respect of that Inquiry, Ms Suzanne Cote, is mandated to present the case to the Inquiry Committee reviewing this matter by marshalling all relevant evidence, both favourable and unfavourable to the judge.

Further to public information about the matter of Associate Chief Douglas' expenses, Ms Cote has asked for a copy of Chief Justice Joyal's letter to the Council, in order to consider whether the issues relating to Associate Chief Justice Douglas' expenses should be explored within the scope of the ongoing Inquiry. Chief Justice Joyal's letter has now been provided to Ms. Cote.

At this time, no other steps are being taken by the Council in relation to the issues raised by Chief Justice Joyal. From an administrative perspective, the matter remains pending. Information about the council can be found on the Council's website at www.cjc-ccm.gc.ca.
