Not necessarily intended for publication - unless you want to - but "bloviated" is an English word, albeit not a common one. I believe it's an archaic colloquialism for "arrogant" and derives from the synthetic verb "to bloviate" - meaning, essentially, to give one's opinions arrogantly and sanctimoniously. I think it was coined by Lewis Carroll in Alice in Wonderland.

Does the Manitoba Metis Federation have a Judiciary Council?

Tansi/Good Day Readers:

The Metis Nation of Alberta's recent Press Release (below) is most instructive for a few reasons:

(1) MNA has a 6 person Regional Representative Metis Judiciary Council in place which not long ago issued a 7 page written decision in an alleged conflict of interest involving a Vice-President (Rick Boucher)

(2) It was made public!

(3) Compare this approach with the case of Darrel Roger Joseph Deslauriers former MMF Provincial Board of Director terminated approximately a month ago:

(i) To date those he represented in the Northwest Region have yet to receive an explanation from Federation headquarters

(ii) Derryl Sanderson (www.derrylsanderson.blogspot.com) reports he has a copy of Mr. Deslauriers' termination letter he'll post as soon as he figures out how. Apparently the reason given by the MMF is the former Director's bankruptcy. But is that the real cause? Are employees who experience financial difficulties routinely fired? Derryl Deslauriers, on the other hand, believes his disagreement with David Chartrand on a few issues resulted in his demise although no specifics have been offered

MNA Judiciary Council Finds Region One Vice-President Violated Metis Nation's Conflict of Interest Prohibitions

Edmonton, AB (December 19, 2007) - Yesterday the Metis Nation of Alberta (MNA) Judiciary Council issued a decision in a conflict of interest complaint filed against Rick Boucher, Vice-President for MNA Region 1.

The complaint was brought forward by MNA President Audrey Poitras, on behalf of seven members of the MNA Provincial Council, including the Presidents of four of the six MNA Regions.

"Now that this process is complete, I look forward to the MNA Provincial Council coming together to work on other issues that are really important to Metis people such as health, housing, harvesting and career development," President Poitras said. "This decision reinforces the need for people to respect Metis government and work together to advance Metis government for the good of Metis people."

The complaint flows from the Provincial Council passing a unanimous motion (that was seconded by Boucher) in February 2007 that the MNA pursue a bilateral agreement with Health Canada for the delivery of the Aboriginal Health Human Resource Initiative ((AHHRI), rather than entering a sub-agreement with the Metis National Council (MNC) for the delivery of this federal program due to concerns raised by the MNA's Minister of Family and Wellness with respect to accountability issues of MNA members.

In March 2007, unbeknownst to the MNA President, the MNA Minister for Family and Wellness, the Provincial Council as a whole or the MNA Region One Regional Council, Boucher entered into an agreement with the MNC for the delivery of the AHHRI through Metco Ventures Inc., a private company he 100% owned as of the date of signing the agreement. The agreement provided that Metco would now deliver health programs to Metis in Alberta rather than through the MNA.

"It is unfortunate that instead of working with and respecting his colleagues who are elected to serve all Metis people across the province, Mr. Boucher decided to pursue his own objectives," Marlene Lanz, Region 3 President and Minister for Family and Wellness said. "With this decision, I hope that the MNA can now finalize the bilateral agreement with Health Canada that was contemplated back in February 2007 in order to increase the number of Metis health professionals in this province and improve Metis health in Alberta.

"It is a very sad day when elected officials put their own self-interests above the Metis people with no regard to the future of our Nation," Sylvia Johnson, President of Region 6 said. "As leaders, we have the responsibility to ensure we are accountable and not have a hand disgracing and embarrassing the Metis Nation publicly."

The MNA Judiciary Council found that Boucher "made a decision to use a company he controlled to take an agreement away from the MNA," that Boucher "owed a duty to the MNA" and that "he had no right to act on his own contrary to the motion" passed by the MNA Provincial Council in February 2007.

The MNA Judiciary Council also wrote,

The MNA could not operate if every Councillor felt entitled to take information obtained through the MNA and then act on their own through other companies preventing the MNA from proceeding with negotiating agreements when the Provincial Council had authorized the negotiation of such agreements. ...

Provincial Council members do not have the right to act on their own because they disagree with the MNA Executives or the MNA Provincial Council. ...

People in the position of Mr. Boucher as a member fo the Provincial Council harm the integrity and credibility of the entire Metis Nation of Alberta by ignoring the process for Governing affairs of the Provincial Council.

In conclusion, the Judiciary Council found Boucher's actions were "a clear breach of the Conflict of Interest prohibitions under Article 22.1 and 22.2 of the Metis Nation of Alberta Bylaws." The Judiciary Council repremanded and immediately suspended Boucher from the Provincial Council and from holding specific positions in the MNA until December 18th, 2010.

"This process shows that the MNA's self-government is strong and that Metis leaders should be held to the same high standards we expect from federal and provincial Cabinet Ministers and MLAs when it comes to avoiding conflicts of interest. The MNA provincial Council members are here to strengthen the Metis Nation and serve all Metis people, not use information obtained through Metis government to advance their own agendas," Cecil Bellerose, Region 4 President said.

"This very serious decision of the Judiciary Council absolutely reinforces the belief of the Metis people in our government, our internal processes and the fundamental principle of good government and accountability," Karen Collins, President of Region 2 added."The elders, youth and membership have anxiously waited for this decision. Now that it has been made, we can move on as the storng Metis Nation that we are."

The compalint was initially filed in May 2007. An initial hearing date for the matter was set for July 20th, 2007. Boucher requested and was granted two adjournments: one to July 30th, 2007 and a second adjournment to September 20th to 21st, 2007. In September 2007, evidence was heard and the matter was adjourned a third time to November 24th and 25th, 2007. The Judiciary Council rendered its formal decision on December 18th, 2007. Adjournment of MNC Assembly Irresponsible And Undemocratic

Edmonton, AB (October 19, 2007) - Audrey Poitras, President of the Metis Nation of Alberta (MNA) has rejected accusations that the MNA was responsible for the failure of the Metis National Council (MNC) General Assembly held in Ottawa on October 13-14.

The MNC General Assembly has been ordered by the court to meet and elect a President from its 55 voting delegates, but it was abruptly adjourned before any voting could take place.

At isue was a motion presented by the President of the Manitoba Metis Federation (MMF) David Chartrand, who immediately challenged the make-up of the MNA delegation of the Assembly.

"Historically, the MNC Assembly has never experienced a situation where one Governing Member with respect to its list of voting delegates, but the past weekend departed from past practice, and clearly it was about the President of the MMF, David Chartrand, trying to manipulate who could vote for Alberta," President Poitras said. "The MNA abides by the rule of law and there is nothing in the law, as it presently stands, that would force me to name only members of Provincial Council to the MNC Assembly. This is a fabrication that cannot stand serious scrutiny."

"Over the years, it has been the practice of the MNC to take a combination of Provincial Council Members, Local Presidents, individual members and sometimes staff members to the MNC Assembly, and has never been challenged or questioned by any Governing Member, ever," Cecil Bellrose, President Region 4 said.

Marlene Lanz, President MNA Region 3, said "the MNA delegation met the requirements of the MNC bylaws as well as the stipulations of the Court Order, under which the Assembly was being held. The court Order stated that the MNA was to have 15 elected provincial voting delegates, and all MNA delegates at the Assembly were elected Metis officials from the Province of Alberta. This included the President of the MNA, six other Provincial Council members, and seven elected officials from MNA Locals across the Province."

The President of MNA Region 6, Sylvia Johnson, also objected to the accusation from David Chartrand that it was undemocratic to name anyone besides Provincial Council members to the MNC Assembly.

"What can be more democratic than appointing elected representatives of the grassroot communities to the MNC Assembly?" she asked. "Past practice has been for the MNA President to name delegates to the MNC Assembly, and this is what occurred in this instance."

When the Chair finally made a ruling, the MNA was prepared to abide by that ruling which would have allowed voting to proceed," President Poitras said. "But in the face of angry opposition from David Chartrand, the Chair, Dale LeClair, Chief Administrative Officer of the MNC, adjourned the meeting which prevented any voting from taking place."

"I am shocked and dismayed that we were prevented from carrying on with the democratic process of a vote on a motion that would have dealt with the issue and would have allowed the meeting to continue to the the final process," Karen Collins, President MNA Region 2 said. "The majority of delegates at the Assembly wanted to proceed to a vote but this was prevented through the actions of David Chartrand. He attacked the decision of the Chair to hold a vote, and created a situation which lead to an adjournment of the meeting. We are now in an unprecedented situation, where the MNC has no President and no ability to even convene a meeting of its Board of Governors."

President Poitras also suggested that if there were any concerns over democracy, these concerns should be directed at what happened at the MNC Assembly. The MNA delegation was accepted as part of the constituted body of voting delegates in a letter from Dale LeClair on October 11, 2007 and by virtue of "roll call" that was read at the opening of the Assembly on October 13, 2007. It was at this point that the President of the MMF argued that only members of MNA Provincial Council could be accepted as voting delegates and he presented a motion challenging the MNA delegation. However, the motion was worded in such a way as to try to exclude the entire MNA delegation from voting on the motion, even though by Chartrand's own admission, at least seven members fo the MNA delegation were, in fact, already members of Provincial Council and thus were not affected by the motion.

Upon seeking expert advice, the Chair than conceded that seven members of the MNA delegation, whose standing was not under dispute, could vote on the MMF motion. This was angrily opposed by the MMF President and the Chair suddenly adjourned the meeting.

Louis Bellerose, Vice-President MNA Region 6, pointed out that "Robert's Rules of Order provided a process to deal with the MMF challenge to the MNA delegation, which the MNA and all other provincial delegations were prepared to accept." However, the actions of the MMF President prevented the exercise of democratic rights of a self-governing Assembly, and imperiled the future of the MNC, which remains without a President or a functioning Board of Governors, since the bylaws require a President to have a quorum."

Bellerose's point was supported by Homer Poitras, Vice-President Region 2, who added, "if the vote had been allowed to proceed, the challenge to the MNA delegation would have been settled by a democratic vote, and the Assembly could have proceeded to the election of the MNC President."

All options on moving forward are on the table," concluded President Poitras." The problems that have brought the MNC to this point stem from its failure to respect the principles upon which the organization was founded in the first place. If the MNC is to survive, it is important for the organization to return to those first principles, above all, the principle of non-interference in the affairs of its provincial Governing Members.

Deslauriers Says MMF Paid Transport Costs For "Group of Seven?"

In a conversation with the recently fired Manitoba Metis Federation Board of Director Darrel Deslauriers, he indicated the MMF paid transportation costs for some Alberta delegates at the recently held Metis National Council Assembly. This is a questionable tactic that is certainly not a democratic move on behalf of the Federation and it's Chief Executive Officer, David Chartrand.
What the hell kind of Department can they take that money from? Youth? Seniors? Education? The MMF had a Board of Directors meeting this past weekend and David's secretary Cindy Miller mentioned my Blog. Reports are that Chartrand payed no mind to what was written here last week.....Word is that when the CEO showed the remaining Board Members the letter that the MMF gave Deslauriers that informed him of his termination, not a question was asked. I have the termination letter, but having some problems getting it on the Blog. I will figure out how soon.

This is further to your letter of December 17, 2007

Please be advised:

(1) At my Examination for Discovery held September 18, 2007 at your Office attended by Co-Defendant Terrance Paul Belhumeur, I specifically asked for particularization of his Examination. You indicated there had been a change about which I would be advised. To date you have not done so which constitutes an abuse of process, clearly breaches Manitoba Court of Queen’s Bench Rules and violates The Law Society of Manitoba’s code of professional ethics and conduct. It will be the basis of yet another complaint against you even though The Society is of somewhat dubious effectiveness when disciplining its Membership

(2) You have failed to advise whether Co-Defendant Belhumeur plans to or has already submitted an Affidavit of Documents to which I will be given access - grounds for a second LSM complaint. You Sir, are ungovernable

(3) On May 1, 2006 I appeared before Madam Justice Deborah J. McCawley, Manitoba Court of Queen’s Bench to challenge your pre-trial Motion to grant an Order forcing Co-Defendant Belhumeur and I to turn over to your care all Manitoba Metis Federation documents in our possession and reveal their source(s)

(i) Several of these documents contained very disturbing information relating to expenditures of taxpayer dollars. Unfortunately, my concern these materials could be shredded or otherwise miraculously disappear was noted by My Lady who on several occasions pointed out it was me about whom she was concerned. Therefore, she could not allow an Examination for Discovery, should one take place, to proceed with documents that may have been obtained through questionable means

(ii) The Honourable Justice McCawley further pointed out all said materials could be subpoenaed at trial. In the interim you would be held exclusively responsible for their safekeeping

(iii) On May 3, 2006 she signed off on an Order which stated in part:

An order directing the defendants Pieuk and Belhumeur to return to the Manitoba Metis Federation Inc. all copies of all internal documents of the corporations listed in 2(i) to (xiv) below:

(i) Manitoba Metis Federation Inc.
(ii) Community Housing Managers of Manitoba Inc.
(iii) Louis Riel Capital Corporation
(iv) Manitoba Metis Community Investments Inc.
(v) Pemmican Publications Inc.
(vi) Metis Child and Family Services Authority
(vii) Metis Women of Manitoba Inc.
(viii) Louis Riel Institute
(ix) Northwest Metis Council Inc.
(x) Interlake Metis Association Inc.
(xi) Southeast Regional Metis Corporation
(xii) Manitoba Metis Federation Southwest Region Inc.
(xiii) MMF The Pas Region Inc.

(4) On three separate occasions beginning late Spring and early Summer 2006 I entrusted a package of Manitoba Metis Federation documents to your Legal Assistant Ms Louise Coulombe. They totalled 1,574 pages and will form the basis of my Affidavit (SCHEDULE A)

(5) Reference your August 29, 2007 Affidavit of Documents. Attention is drawn to entry 110:

* Only after being served with the Plaintiffs’ Statement of Claim (May 28, 2005) did I initiate a series of meetings with senior staff at the Office of the Auditor General of Manitoba to begin turning over documentation in my possession. On October 24, 2005 the fourth in a series of meetings took place (Deputy Auditor General Bonnie Lysyk in attendance) with three senior OAG officials. It was subsequently decided since the MMF receives over 95% of its taxpayer dollars from Ottawa, the balance from Manitoba, the OAG was prepared to enter into a joint federal-provincial forensic review. I then directed Ms Lysyk to transfer the material to Mr. Christian Asselin, Director, Office of the Auditor General of Canada

Recall Counselor Trachtenberg at your September 18, 2007 Examination for Discovery, I specifically asked if you were in possession of the aforementioned documentation. Your response was you were not. The fact they are listed in your Affidavit of Documents suggests otherwise

Shortly I will be writing to Canada’s Auditor General for confirmation said material is still in their possession. If not I will inquire of senior Federal Cabinet Ministers as to the propriety of a citizen releasing confidential documents in support of a request for a forensic audit only to have them subsequently released to an attorney representing the taxpayer funded organization in question

(6) Therefore, you have at least one set, and it would appear two, of the documents required to prepare SCHEDULE A of my Affidavit. Whereas yours has 118 entries mine will comprise over 1,000. As soon as said materials are temporarily returned I will immediately comply with the request

(7) In the meantime, SCHEDULE B will be surface mailed “forthwith” (immediately; without delay; at once) and posted on this site

The Manitoba Metis Federation Leadership’s use of hundreds and hundreds and hundreds of thousands of Canadian taxpayer dollars to sue private citizens who dare to criticize it must stop and it will!

Wait until you read his file at the Provincial Law Courts Building in Winnipeg - you'll be able to add a few more choice descriptives. Interesting comparison although Mr. Boddy is much better looking at least giving the appearance he's got a Clue to what's happening.

Clue is a the 1985 comedy film based on the board game Clue (also known as Cluedo). It is a murder mystery set in a Gothic mansion. The style takes the idea in the direction of Murder By Death and other various murder/dinner parties of mystery. The film was directed by Jonathan Lynn, who collaborated on the script with John Landis. It stars Tim Curry, Eileen Brennan, and Madeline Kahn alongside an ensemble cast of characters.

To prevent the ending from being revealed by the Press or by word of mouth, three separate endings were filmed. In spite of this marketing gimmick, the film did poorly at the box office and received mixed reviews. On its 38th day of release, the reported box office earnings were only $13,377,261. In later years, it has become a cult film.
